WAIVER FOR ALL PLAY AREAS AND BOUNCERS

This is a legal document between the client (“the Renter”) and NYC KIDS PARTY ENTERTAINMENT INC, which affects your legal rights, so please read carefully.

The Renter desires to rent equipment from NYC KIDS PARTY ENTERTAINMENT INC to be used by the Renter, their guests, invitees, or other individuals while in the Renter’s possession. The Renter understands that use of this soft play equipment may, by its nature, cause injury or harm.

The Renter does hereby freely, voluntarily, and without duress execute this release under the following terms:

Renter understands and acknowledges that this release discharges NYC KIDS PARTY ENTERTAINMENT INC and its affiliates from any liability or claim that the Renter may have with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the use and possession of the equipment.

Renter releases and forever discharges NYC KIDS PARTY ENTERTAINMENT INC, its successors, assigns, employees, and affiliates from any and all liability, claims, and demands of any kind or nature, whether in law or equity, arising from use of the equipment.

Renter understands that insurance for liability, health, medical, or disability coverage related to the rental of equipment is the sole responsibility of the Renter.

Renter agrees to indemnify and hold harmless NYC KIDS PARTY ENTERTAINMENT INC from any liability resulting from use of the equipment by the Renter, guests, invitees, or any other individuals while in the Renter’s possession.

This agreement shall be governed by and interpreted in accordance with the laws of the State of New York. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

By signing below, I forfeit all rights to bring a suit against NYC KIDS PARTY ENTERTAINMENT INC and its affiliates. I agree to follow all safety rules and will ask for clarification if needed.

PLAY AT YOUR OWN RISK

• Children must be supervised by an adult (18+) at all times 
• NO shoes, sneakers, high heels, flip flops, or sandals on mats
  (High heels will result in $100 per tile damage fee) 
• NO face paint (do not book if face painter is present) 
• NO food, drinks, candy, or gum in play area 
• NO running 
• NO diving or throwing balls out of ball pit 
• DO NOT remove equipment from play area 
• Avoid mixing large and small children 
• NO pushing, wrestling, rough play 
• Designed for children under 5 years old 
• NO messy items (glitter, slime, confetti, paint, tattoos, etc.) 
• Do not exceed recommended number of children 
• Remove all sharp objects (jewelry, glasses, pens, etc.) 
• DO NOT use if pregnant or with physical limitations 

• I am responsible for enforcing all rules 
• I accept full responsibility for all users of the equipment 
• I agree to RELEASE, DEFEND, INDEMNIFY, and NOT SUE NYC KIDS PARTY ENTERTAINMENT INC for any injuries, damages, or expenses (including legal and medical fees) 

• Deposit required to reserve date 
• Full payment due on event day 
• $100 cleaning fee if equipment is returned excessively dirty 
• Full cost of repair/replacement for damaged or stolen items 

I acknowledge risks including (but not limited to): choking hazards, falls, injuries, or other accidents. I participate voluntarily and assume all risks.

By submitting this form, I confirm I have read, understood, and agreed to all terms.

The Renter is responsible for ensuring all safety precautions are followed.

1. Age limit: 5 years old (no adults) 
2. No food, drinks, gum, or candy 
3. Remove shoes, glasses, jewelry 
4. No face paint, slime, confetti, or similar materials 
5. No smoking 
6. No BBQ or grills nearby 
7. No climbing or sitting on walls 
8. Adult supervision required at all times 
9. Do not overcrowd 
10. No pushing or rough behavior 
11. No pets or sharp objects 
12. Do not bounce on entrance step 
13. No use during inflation/deflation 
14. No flips or somersaults 
15. If blower stops: remove children immediately and check power 
16. Supervision required at all times 
17. No water use 

1. Equipment is received in good condition and must be returned the same 
2. Cleaning fees may apply 
3. Customer assumes all responsibility for injuries and damages 
4. NYC KIDS PARTY ENTERTAINMENT INC may enter premises to retrieve equipment 
5. Customer agrees to cover legal and collection costs 
6. Equipment cannot be moved, sublet, or relocated 
7. Customer responsible for up to full replacement cost
